Options to Resolving Problems

The following are options available in attempting to resolve problems with a dentist, dental hygienist, or denturist: THROUGH THE ARIZONA STATE BOARD OF DENTAL EXAMINERS: • Mediation - This service is provided by the Board at no cost and is designed to enhance communication between the patient (Complainant) and the dentist, hygienist or denturist (Respondent) in a effort to arrive at a mutually acceptable compromise. The compromise may result in voluntary repayment to the Complainant once the mediation agreement is approved by the Board at its next scheduled meeting. The law states a preference for informal settlements and mediation could result in the most effective and efficient result. • The Complainant may elect to file a complaint and proceed through the investigatory and adjudicative process with the Dental Board. The Complainant needs to know some of the Dental Board's following statutory limitations. If the Dental Board finds that a licensee violated the Dental Practice Act because of inadequate dental work, restitution may be ordered. This means any fees the patient paid are ordered returned to the patient, and any fees paid by insurance are returned to the insurance company. The Dental Board does not have the power or authority to award any additional monies to the patient. The Dental Board does not want to discourage a valid complaint being filed. But, the Dental Board is an administrative regulatory agency and therefore it's jurisdiction and authority are limited. It also should be noted, complaint files and records are confidential investigative materials, and by law, availability is restricted. OTHER OPTIONS: • If the Complainant has not talked to the Respondent to address the basis of the complaint, he/she is encouraged to do so. If the Complainant feels too intimidated or has failed verbally, a written request for resolution from the Complainant to the Respondent is suggested. • If the dentist is a member of the Arizona State Dental Association, peer review may be requested through the Association. |
